Cascada Mobile is committed to revolutionizing the way that people access and share mobile content. To provide as streamlined an experience as possible, we collect, store and utilize detailed consumer information. Cascada Mobile’s business is built on trust, between publishers, carriers and consumers, and we strive to protect any information that can be used to personally identify users (“Personal Information”). It is important to us that our customers get recommendations that have value to them and therefore we attempt to protect them from abuses of the system or their Personal Information by others. Our policies require that consumers be able to opt-out of all messages from us easily and at any time. We want our customers and partners to be confident that we will not use any information given to us for purposes other than those communicated when we acquire the information. Cascada Mobile has also adopted the privacy guidelines certified by TRUSTe and used by leading brands and carriers.

Our policies are based on the following beliefs:

  • Customer protection is at the core of our business’ sustainability.
  • Customers should be aware as to what Personal Information is collected, and how their Personal Information will be used and/or disclosed.
  • Customers should have an easy option to limit the use and/or disclosure of any Personal Information.
  • No information about the consumer should be shared with a third party except in the form of aggregated data with the exception of their wireless telecommunications provider (“Carrier”).
  • Information about customers should be accurate and maintained in secure systems.
  • Our privacy policy is always posted on our website and we will keep customers informed through this site of any changes to our policy.


These beliefs are reflected in Cascada Mobile’s contractual restrictions with our partners, the technical controls we have established in our recommendation software and our internal practices. We believe that the customer always has the right to choose not to participate in the recommendation of content and applications or to choose from whom they’ll receive communications.

Cascada Mobile may update its Privacy Policy to reflect changes in the services that Cascada Mobile offers; however, the underlying goal of protecting end user privacy remains the same. By using Cascada Mobile’s services, customers and end users agree to accept this Privacy Policy and are aware that Cascada Mobile’s Privacy Policy may change from time to time and your continued use of the Cascada service will represent your willingness to be bound by this Privacy Policy as modified. You are advised to review this page regularly for any changes.

Eligibility
Cascada Mobile does not intentionally collect or use personal information about individuals under the age of 13. Cascada Mobile reserves the right to delete, move, edit, refuse to post or take other appropriate action with respect to any messages, information or files which Cascada Mobile, in its sole discretion, deems objectionable or otherwise in violation of the terms and conditions of this Agreement.

Information Collection & Use
Cascada Mobile only acquires Personal Information when you use our recommendation system (“Cascada Mobile TAG” or “TAG”) to send or receive a recommendation from an application registered to use our service.

Cascada Mobile does not capture any customer information on our corporate website unless a client specifically contacts us via e-mail.

Generally, Cascada Mobile’s contact with you will be via a text message (“SMS”) or a message containing a link (“WAP Push”) sent to your mobile phone. We realize that there may be a charge to you from your wireless telecommunications provider (“Carrier”) for the delivery of the message and fees associated with accessing content. Cascada will work with Carriers to make these free to you whenever possible.

Cascada Mobile and the customer’s Carrier are the sole owners of the information collected with respect to the TAG service. Cascada Mobile collects Personal Information from our users at several different points in the service.

Cascada Mobile will never sell, rent or share your personally identifying information with anyone except your Carrier and third party service providers used in order to provide you with Cascada’s service. We also go to great lengths to protect your Personal Information when it is stored on our systems.

For European Users
As part of the services offered to you, the information you provide to us may be transferred to countries outside of the European Economic Area (“EEA”).  By way of example, this may happen where transfers are to our offices and group companies located outside the EEA (for details of our group see www.cascadamobile.com), when our servers are from time to time located in a country outside of the EEA or one of our service providers is located in a country outside of the EEA.  These countries may not have similar data protection laws to the EEA.  If we transfer your information outside of the EEA in this way, we will take all reasonable steps to ensure that your privacy rights continue to be protected.

In addition, if you use our services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those services.

On Recommendation Initiation
When you send a recommendation to a friend, we capture and store your phone number, name and a unique identifier created by your carrier called a Subscriber ID Number. This is a unique identifier that your carrier can use to protect your identity while allowing third party sites to provide and bill for services. In addition, we capture what device that you’re using to allow us to better understand, in aggregate, how people are using our service. We also provide this device information in aggregate form to application publishers so that they can better understand how, in aggregate, how customers use their applications. Your Carrier may also be able to get detailed information of your use of our service subject to the terms and conditions of your relationship with them.

On Recommendation Acceptance
When the person receiving the recommendation accepts it, we capture and store information about them and their device so that we can offer the service to them.
This information is made available in aggregate to application publishers and Carriers. The detailed information is also made available to the customer’s Carrier. Only the customer’s Carrier will ever be able to retrieve individually identifying information. In addition, this Personal Information will never be provided to any other third party.

Surveys or Contests
From time-to-time, and in conjunction with Carriers and application publishers, we may provide you the opportunity to participate in contests through our service.  If you participate, we will request certain Personal  Information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information.  The requested information typically includes contact information (such as name and shipping address), and may request optional demographic information (such as age and postal or zip code). 

We use this information to award prizes and, in aggregate to better understand our customers so that we can improve our service.

Communications from the Service

Special Offers
We may occasionally send you messages informing you of promotional offers or contests that we are running. These messages will only be sent out with the consent and knowledge of your Carrier. 

Out of respect for your privacy, we present the option not to receive these types of communications.  Please see the “Choice and Opt-out” section below.

Service-related Announcements
We will send you strictly service-related announcements on rare occasions when it is necessary to do so.  For instance, if our service is temporarily suspended for maintenance, we might send you an SMS or WAP Push. 

You may opt-out of these communications if you wish but it may impair our ability to provide you with feedback on service affecting outages which may impact your experience with our service.  Please see “Choice and Opt-out.”

Profile
We store information that we collect through your usage of the service to create a personal “profile” including the first name that you give us, your phone number and phone type.  We also tie your Personal Information to information in the profile, in order to provide the ability for your Carrier and publishers (only with the Carrier’s consent) to send tailored promotions and marketing offers to you.

We never share your profile with other third parties with the possible exception of your Carrier. We also share some of your profile information in aggregate form only with publishers.

We never share any of your information with any other third parties.

Information Sharing and Disclosure

Aggregate Information (non-personally identifiable)
We share aggregated demographic information about our user base with our publisher and Carrier partners.  This information does not identify individual users. We may also share aggregated data with potential partners and at trade shows to promote our services. This sharing will never contain personally identifiable information.

Affiliates, Subsidiaries and Service Providers
We may share your Personal Information with our affiliates, subsidiaries and service providers for the purpose of providing the Cascada Mobile service to the end user, provided that the information is required for and used only for such purpose and provided the information is used in accordance with the principles set forth in this Privacy Policy.  We will otherwise only release Personal Information to third parties in the following limited circumstances: (i) if a law, regulation, search warrant, subpoena or court order legally requires us to do so; (ii) if our rights or property or the rights or property of our affiliates, subsidiaries, service providers or the users of our web site or services are in jeopardy; or (iii) if the personal safety of users of our web site or services or other members of the public is in jeopardy.

Carriers have their own privacy policies and it is also stipulated in your Terms of Service with your Carrier how this information can be used. Please contact your Carrier if you need clarification on how they use your Personal Information.

Agents 

We may use an outside shipping company to fulfill prizes and incentives.

These companies do not retain, share, store or use personally identifiable information for any other purposes.

Legal Disclaimer
We reserve the right to disclose your Personal Information as required or permitted by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served with regards to the Cascada Mobile TAG service.

Choice/Opt-out
We provide you the opportunity to ‘opt-out’ of receiving messages from us, from our publisher and Carrier partners and from other users of our service upon the receipt of every message from us.

If you no longer wish to receive messages from us, our publisher and Carrier partners or other customers, including promotional messages by following the instructions included on the landing pages for each message or by contacting us at www.cascadamobile.com.

Log Files
As is true of most Web sites, we gather certain information automatically and store it in log files.  This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. 

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole. 

We do not link this automatically-collected data to personally identifiable information.

Cookies
A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We do not use cookies on this site.

This Web site may contain links to other sites that are not owned or controlled by Cascada Mobile. Please be aware that we, Cascada Mobile, are not responsible for the privacy practices of such other sites.

Security
We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it.  No method of transmission over the Internet or through a wireless network, or method of electronic storage, is 100% secure, however.  Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
